You are a Prosecuting Attorney for the Essex County Prosecutor's Office. The head prosecutor has assigned you the following case that she has demanded you not offer any plea bargains to the Defendant and are to handle the jury trial without assistance.

Facts: Two months ago, two rival gangs (The Reds and The Blues) had a "shootout" on Broad St. at 2 a.m. The gangs agreed to have members duel each other from fifty yards apart, shooting until one of the members is dead. Spectators lined the streets to watch the gangs duel till the death. The gangs used .38 caliber handguns for the duel.

During the third duel, Armand, 17, a new gang member of the Reds, went against Jose, 23. After each firing several shots, and moving closer to one another, Armand pulled out an Uzi machine gun and fired a spray of bullets, killing Jose, and hitting six other spectators. Armand was identified as the shooter by one of the injured spectators and arrested several weeks later.

Armand has been charged with First Degree Murder, Six counts of Attempted Second Degree Murder, Six counts of Aggravated Assault, Possession of a Semi-Automatic Weapon, and one count of Maiming.

The Reds and Blues are very popular in Newark and gang loyalties run deep.
